Terms of Service

These Terms of Service ("Terms") govern your access to and use of KitchenReady (the "Service"), a field site-survey application for commercial-foodservice equipment dealers, operated by 10hours.ai (also operating as AI Elevates LLC) ("KitchenReady," "we," "us," or "our"). Please read them carefully.

1. Acceptance of These Terms

By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you are using the Service on behalf of a company or other organization, you represent that you are authorized to accept these Terms on its behalf. If you do not agree, do not use the Service.

2. Description of the Service

KitchenReady is a Progressive Web App that helps commercial-foodservice equipment dealers conduct field site surveys. It lets you capture and organize information about commercial kitchen sites — including text notes, dimensions, utilities, equipment details, photos, video, and voice recordings — and use optional AI features to suggest equipment details and transcribe voice notes. The Service is designed to work offline and sync when connectivity is available.

3. Accounts and Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate account information and to keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly if you suspect any unauthorized use.

4. Acceptable Use

You agree to use the Service only for lawful, professional, business purposes, and not to:

• Use the Service in violation of any applicable law or regulation.
• Upload, capture, or store photos, recordings, or other data about a site or person without the authorization or permission you need to do so.
• Infringe the intellectual property, privacy, or other rights of others.
• Attempt to gain unauthorized access to the Service, other users' accounts, or our systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Upload malicious code or use the Service to transmit harmful or unlawful content.
• Reverse engineer or attempt to extract source code, except to the extent this restriction is prohibited by law.

You are responsible for the content you capture and store, and for ensuring you have the right to do so — particularly when surveying customer or third-party premises.

5. Subscriptions, Billing, and Cancellation

Field is free. Paid plans are Solo, Dealer, and Dealer Plus. Paid plans offer monthly billing; Dealer also offers annual billing. Features, prices and the selected billing period are shown before you subscribe.

• Payment. Subscriptions are billed through our payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your selected payment method at the price and recurring billing period you select until you cancel. Annual billing charges the full year upfront, not monthly installments.
• Cancellation. You can cancel at any time. Your subscription will remain active through the end of the current billing period, after which it will not renew.
• Refunds. Payments are non-refundable, and we do not provide refunds or credits for unused portions of a billing period, except where a refund is required by applicable law.
• Changes. We may change plan features or pricing. We will give reasonable notice of price changes, which take effect on your next billing cycle.

6. AI Features

The Service includes optional AI features that suggest equipment make, model, and specifications from photos and that transcribe voice recordings. These outputs are generated by automated systems and are not guaranteed to be accurate or complete.

You must review and verify all AI-generated suggestions and transcripts before relying on them or saving them into a survey. AI output is provided to assist you and is not a substitute for professional engineering, code, or compliance judgment. Site-survey documents may inform purchasing, installation, and code-related decisions, so you remain solely responsible for confirming that any information is correct and appropriate for its intended use. Always confirm equipment details and measurements independently.

7. User Content and Ownership

As between you and KitchenReady, you own the survey data, media, and other content you create or upload ("User Content"). We do not claim ownership of your User Content.

To operate the Service, you grant us a limited, non-exclusive, worldwide license to host, store, process, transmit, display, and back up your User Content, and to share it with our subprocessors (such as our infrastructure, payment, and AI providers) solely as needed to provide and improve the Service. This license exists only to let us run the Service for you and ends when your content is deleted, subject to routine backup expiration.

8. Intellectual Property

The Service itself — including its software, design, branding, and the KitchenReady name and logo — is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or other brand features without our prior written permission. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any AI-generated output will be accurate, reliable, or complete. You use the Service and any AI output at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, KitchenReady and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless KitchenReady, its operator, and their respective personnel from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms or of any law or the rights of a third party.

12. Termination

You may stop using the Service and delete your account at any time from your Account settings. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and indemnification — will continue to apply.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules. You agree that the courts located in the Commonwealth of Virginia, United States will have jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where applicable law provides otherwise.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Service after an update means you accept the revised Terms.
